Refund and Cancellation Policy — CargoScreen

1. Scope and how this Policy is structured
1.1. This Policy explains cancellation and refunds for paid use of CargoScreen. It forms part of the Terms of Use.
1.2. Your rights depend on who you are:
- Business Users (acting for business purposes) — clause 2. No statutory withdrawal right; contractual rules apply.
- Consumers (natural persons acting outside their business) — clause 3. Mandatory EU/Latvian consumer-protection rules apply and cannot be waived.
1.3. If in doubt, the consumer rules in clause 3 apply to natural persons buying for private purposes.
2. Business Users (B2B)
2.1. Cancellation. You may cancel a Subscription at any time through your Account. Cancellation takes effect at the end of the current billing period. You keep access until then.
2.2. No refund of the current period. Fees already paid for the current period are non-refundable, and we do not refund unused time within a paid period. This is a negotiated allocation reflected in the price.
2.3. Exceptions. We may, at our discretion, issue a refund or credit (e.g. for prolonged service unavailability attributable to us). Where we terminate for convenience under the Terms, we refund prepaid, unused fees pro rata (Terms clause 9.3).
2.4. Downgrades take effect at the next billing period; no refund for the difference within the current period.
3. Consumers — statutory rights (mandatory)
If you are a Consumer, the following applies in addition to anything in clause 2, and prevails over any conflicting term.
3.1. 14-day right of withdrawal (cooling-off)
Under Directive 2011/83/EU and the Latvian Consumer Rights Protection Law and Cabinet Regulation No. 255 on distance contracts, you have the right to withdraw from a distance contract within 14 calendar days without giving any reason. For services, the period runs from the day the contract is concluded.
Because CargoScreen is a paid digital service, the effect of withdrawal depends on what you bought:
3.2. One-off purchases (e.g. a single screening, a single PDF report, a credit consumed immediately)
3.2.1. If you ask us to begin performance immediately (during the 14-day period) and expressly acknowledge that you will lose your right of withdrawal once the service is fully performed, then, once we have fully performed (delivered the single result/report), you no longer have the right to withdraw and the purchase is non-refundable. This is the exception in Article 16(a) of Directive 2011/83/EU.
3.2.2. We obtain this express request and acknowledgement at checkout through a specific, separate confirmation (not a pre-ticked box) and confirm it to you on a durable medium (e.g. email). Without that express consent and acknowledgement, your 14-day right remains and we refund a purchase not yet consumed.
3.3. Subscriptions (ongoing digital service — Pro, Team, monthly/annual)
3.3.1. A Subscription is an ongoing digital service, not one-off digital content. For an ongoing service, the right of withdrawal is not lost merely because performance has begun; it ends only once the service is fully performed — which does not happen within the first 14 days of a subscription.
3.3.2. Therefore, if you withdraw within 14 days of subscribing:
- if you asked us to start immediately, you must pay a proportionate amount for the part of the service actually provided up to the moment you tell us you withdraw (Article 14(3) of the Directive), and we refund the balance;
- if performance had not yet started, we refund the full amount.
3.3.3. We cannot and do not require you to waive this right for a subscription; any term to the contrary does not apply to you.
3.3.4. After the 14-day period, ordinary cancellation applies: you may cancel at any time with effect from the end of the current billing period; fees already paid for the current period are not refunded, and the subscription does not renew. This does not affect your statutory rights where the service is faulty (clause 3.5).
3.4. How to withdraw
3.4.1. To withdraw, tell us clearly before the 14 days expire — by email to support@cargoscreen.eu, or using the model withdrawal form in the Annex. You may use any clear statement; the model form is optional.
3.4.2. Refund method and timing. We refund using the same payment method you used, without undue delay and within 14 days of being informed of your withdrawal (subject to the proportionate deduction in clause 3.3.2). No fees are charged for the refund itself.
3.5. Faulty or non-conforming service (separate from withdrawal)
3.5.1. Independently of the 14-day right, if the digital service does not conform to the contract, you have statutory remedies under Directive (EU) 2019/770 as implemented in Latvia (e.g. bringing the service into conformity, price reduction, or, in serious cases, a refund). These rights are free of charge and are not time-limited to 14 days. Contact support@cargoscreen.eu.
4. Situations that are not refundable (all Users, subject to consumer rights)
Subject always to Consumers' statutory rights above, the following are not grounds for a refund:
- change of mind after a one-off result has been delivered with your express consent (clause 3.2);
- unused time in a paid period after the cooling-off period;
- suspension or termination for your breach of the Terms (including sanctions/AUP breaches);
- dissatisfaction with a Verdict, given the Service is an indicative information tool and not advice (see Terms clause 4).
5. Price changes
If we change the price of your plan, the change applies from the next billing period, with at least 30 days' notice; you may cancel before it takes effect (Terms clause 8.7). We do not retroactively change the price of a period already paid.
6. Chargebacks
If you have a billing concern, please contact us first at support@cargoscreen.eu — we aim to resolve issues quickly. Initiating a chargeback without contacting us may lead to suspension pending resolution; this does not affect your right to complain to the authorities (clause 7).
7. Consumer dispute resolution
7.1. If you are a Consumer and we cannot resolve a complaint, you may contact the Consumer Rights Protection Centre (Patērētāju tiesību aizsardzības centrs, PTAC), ptac.gov.lv, or use the EU Online Dispute Resolution (ODR) platform where available. Complaints to Latvian authorities are handled in Latvian.
7.2. A Consumer may also bring proceedings in the courts of their EU country of habitual residence. Nothing here limits your statutory rights.
